76-7-101. Bigamy -- Defense -- Testimony.
(1) A person is guilty of bigamy when, knowing he has a husband or wife or knowing the other person has a husband or wife, he purports to marry another person or cohabits with another person.
(2) Bigamy is a felony of the third degree.
(3) It shall be a defense to bigamy that the accused reasonably believed he and the other person were legally eligible to remarry.
(4) Any person, except the defendant, may be compelled to testify in a prosecution under this section...

 

30-1-2. Marriages prohibited and void.
The following marriages are prohibited and declared void:
(1) when there is a husband or wife living, from whom the person marrying has not been divorced;...

 

30-1-4. Validity of foreign marriages -- Exceptions.
A marriage solemnized in any other country, state, or territory, if valid where solemnized, is valid here, unless it is a marriage:
(1) that would be prohibited and declared void in this state, under Subsection 30-1-2(1)...

 

30-1-15. Solemnization of prohibited marriage -- Penalty.
If any authorized person knowingly, with or without license, solemnizes a marriage such as is herein prohibited, he shall be imprisoned in the state prison not exceeding three years, or fined not exceeding $1,000, or be both so fined and imprisoned.

 

76-7-103. Adultery. (1) A married person commits adultery when he voluntarily has sexual intercourse with a person other than his spouse.
(2) Adultery is a class B misdemeanor.

 

76-3-204. Misdemeanor conviction -- Term of imprisonment. A person who has been convicted of a misdemeanor may be sentenced to imprisonment as follows:...
(2) In the case of a class B misdemeanor, for a term not exceeding six months;

 

76-3-203. Felony conviction
(3) In the case of a felony of the third degree, for a term not to exceed five years...
